The Buyer is the holder of the account to which the order is linked, or the organization represented with authority. In transactions by minors, the legally required consent of a representative and the conditions of capacity apply. Email is the preferred support channel; other notification methods valid under the law are reserved.

The monthly equivalent price shown on a yearly plan is not an instalment amount; the yearly total is charged in advance. One-time additional credits do not renew automatically. Using the service requires an internet connection, a compatible browser and the connections the relevant features require. Significant device, browser and format compatibility limitations are shown in the relevant feature and purchase explanations.

C. Important limits of the service

In web projects the source code cannot be downloaded or exported; editing is done through Firevibe. No separate quantity limit applies to mobile source code export. As well as generation, workspace, database, storage and in-app AI use also consume credits. Serving the site to visitors does not consume credits; however, the database, storage and in-app AI used by visitor operations do consume credits. A project may spend credits without new generation. The monthly credits under a subscription do not carry over to the next period; at the start of each period that period's credit amount is defined anew, and it is reset to zero when the subscription ends. Separately purchased additional credits have no expiry; they are not deleted at the end of a period, no accumulation cap applies to them, and they remain in the account after the subscription ends. In credit use, the monthly credits are used first and the additional credits after them. Credits taken back through a statutory refund, corrections of erroneous allocations and lawful account termination operations are reserved. The consumption of the different allocations may not create a retroactive change of value or a hidden fee to the user's detriment.

Publishing requires a paid plan that includes this feature. Running out of credit balance does not take a site offline; however, functions that require credits, such as in-app AI, do not work until balance is provided. When the plan ends, the site stays online for seven more days with two warnings sent, and is then taken offline. The stopping of publication is not, by itself, the deletion of the project or the database. In a failed generation, no credits are taken beyond the part completed before the failure.

D. Term, cancellation, withdrawal and refunds

The subscription continues until it is ended by cancellation or termination. The monthly or yearly payment period is chosen at the time of purchase and shown in the order summary. Cancellation and termination requests may be submitted from Settings → Billing → Manage subscription or through help@firevibe.ai. Stopping future renewals and the statutory right of termination, with the associated right to a refund of the price, are assessed separately.

The performance of the service begins immediately upon the completion of the purchase, in line with the early performance confirmation the Buyer gives on the payment screen. Through the acceptance statement on the payment screen, the Buyer expressly confirms that they have requested the service to be started before the withdrawal period ends and that they have been informed of its effect on the right of withdrawal.

Under Article 15(1)(h) of the Regulation on Distance Contracts, the right of withdrawal may not be exercised in respect of a service whose performance has begun, with the Buyer's confirmation, before the withdrawal period ends. For a service whose performance has begun under these conditions and which has been provided in accordance with the contract, applying within fourteen days of the purchase, or claiming a purchase by mistake, a change of mind, no longer needing the service or a difference of personal taste, does not by itself give rise to a right of withdrawal or refund.

Apart from statutory obligations, Firevibe does not offer voluntary satisfaction refunds or unconditional refunds. These statements do not remove liability for defective services or services not provided at all, for erroneous or duplicate charges, for the statutory termination of the subscription, or for the refund rights arising from other mandatory provisions.

In consumer transactions where the conditions of the withdrawal exception are not met, the statutory fourteen-day right of withdrawal from the conclusion of the contract and the statutory consequences of incomplete information are reserved. The withdrawal notice may be sent in writing or through a durable medium, through any valid notification channel including help@firevibe.ai; the use of a model form is not mandatory. Upon a valid withdrawal, the amount to be refunded is refunded within fourteen days at the latest from the receipt of the notice, in a manner consistent with the payment instrument used at the purchase and without imposing any cost on the Buyer.

The details of the cancellation, termination, withdrawal and refund terms are set out in the Distance Service Agreement on Subscriptions and Credit Use and the Cancellation, Withdrawal and Refund Policy, which are made accessible before payment.

E. Remedies and confirmation

Complaints may be submitted through help@firevibe.ai. A consumer in Turkey may apply to the consumer arbitration committee within the current monetary limits, or to the consumer court once the procedural conditions and, where required, mediation have been completed. Applying to the support team is not a precondition for the statutory applications. Inalienable rights of application in other countries are reserved.

The Buyer sees and confirms this information before entering into a payment obligation. That the order is subject to payment is clearly stated on the payment button. The confirmation of the pre-contractual information, the approval of early performance, the marketing permission and the explicit consent for personal data are separate from one another.
