Firevibe Terms of Service

These Terms of Service ("Terms") are an agreement between you and CREART LLC, a Delaware limited liability company ("Firevibe", "we", "us" or "our"), 364 E Main St Ste 1001, Middletown, Delaware, USA. They govern your use of the website at https://firevibe.ai, the Firevibe app and all related services (together, the "Services").

These Terms apply to users located outside Turkey. If you are located in Turkey, the Turkish user agreement and the related Turkish documents apply instead.

1. Accepting these Terms

By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and "you" includes that organization.

2. Your account

You must be at least 18 years old, or the age of majority where you live if that is higher, to create an account.

You agree to give accurate information and keep it up to date, to keep your sign-in details secure, and not to share your account with anyone else. You are responsible for all activity under your account. If you suspect unauthorized access, tell us right away at help@firevibe.ai.

3. The Services

Firevibe provides AI-assisted tools to build, edit and publish websites, web apps and mobile designs, together with hosting, storage and related infrastructure. The features and limits of your plan, including the number of projects, are those shown on our pricing page and at checkout when you buy.

We may change, improve or remove features over time. We will not reduce what you have already paid for during the period you have paid for.

Web projects are built and edited inside Firevibe. Downloading or exporting their source code is not offered.

Mobile project export is available on paid plans, in the formats your plan includes, with no limit on the number of exports. Converting a project to another framework uses credits. An export does not guarantee approval by any app store or the availability of any third-party service.

4. Plans, billing and renewal

Paid plans are subscriptions, billed in advance monthly or yearly through our payment processor, Stripe. Your subscription renews automatically at the end of each billing period, at the price then in effect, until you cancel.

On a yearly plan, the full year is charged upfront, and your plan's monthly credit amount is provided each month of the paid year.

The price, the currency and the billing period are shown at checkout before you pay. If a price changes, we will tell you before the new price applies to your next renewal, so you can cancel first if you prefer.

Credit packs are one-time purchases. Buying credits does not start or renew a subscription.

If a renewal payment fails and is not resolved, your subscription may end.

You can cancel at any time from Settings → Billing → Manage subscription, or by emailing help@firevibe.ai. Our Refund and Cancellation Policy explains what happens when you cancel and when refunds apply.

5. Credits

Credits are the unit used to measure usage of the Services.

What uses credits. AI operations, including generation, editing, voice typing and in-app AI, use credits. So do workspace time and your projects' database and file storage. Serving a published site to its visitors does not use credits. However, when visitors' actions use your site's database, storage or in-app AI, that usage uses credits. Credits can therefore be used even when you are not generating anything.

Monthly credits. At the start of each billing period, your monthly credits are set to your plan's monthly amount. Unused monthly credits do not carry over to the next period, and they end when your subscription ends.

Purchased credits. Credits you buy separately do not expire, have no cap, and stay in your account after your subscription ends.

Order of use. Monthly credits are used first, then purchased credits.

Errors. If an AI operation fails, you are charged only for the work it completed before the failure, if any. If you believe credits were charged by mistake, tell us and we will review and correct any error.

Zero balance. If your balance reaches zero, your published sites stay online. Features that need credits, such as AI generation and in-app AI, stop working until you have credits again, for example when your monthly credits renew or when you buy credits.

In-app AI. Your app can use AI through Firevibe for its own features. Our AI agent may turn this on when your app needs an AI feature. Requests made by your app and its visitors use your credits, up to the daily limit you can set in your project's Resources → AI panel, where you can also turn it off.

Credits have no cash value. They are not money, a deposit or stored value, and they cannot be transferred or sold. You can see your credit balance and usage in your account.

6. Projects and collaborators

You can have as many projects at the same time as your plan allows. Deleting a project frees its place.

If your plan changes and you have more projects than the new plan allows, none of your projects are deleted. Projects above the limit are locked and cannot be edited until you delete projects or upgrade your plan.

You can invite collaborators to your web projects, up to your plan's limit. You are responsible for the people you invite and for what they do in your projects.

7. Publishing

Publishing requires a paid plan that includes publishing. Published sites are served at a firevibe.dev address, or at your own domain if your plan includes custom domains. You are responsible for any domain you connect.

When your plan ends. Your published site stays live for 7 more days, and we email you two warnings during that time. After that, the site is unpublished. Unpublishing does not delete your project or its database. To publish again, you need a plan that includes publishing.

Custom domains. If you move to a plan that does not include custom domains, we email you, and after 7 days your custom domains are paused, not removed. Your site stays live at its firevibe.dev address, and your domains resume if you move back to a plan that includes them.

Your plan does not include unlimited hosting or infrastructure. We may review or limit abnormal traffic or use that harms the Services or other users.

8. Your content

You keep ownership of the content you provide to the Services, such as prompts, text, images, files and code ("Inputs"). As between you and us, and to the extent the law allows, you own the content the Services generate for you ("Outputs").

You give us a non-exclusive license to host, store, copy, process, transmit and display your Inputs and Outputs only as needed to provide, maintain and secure the Services, including through the service providers that work for us, and to publish them when you ask us to. This license does not allow us to use your content for advertising or marketing unrelated to providing the Services.

We do not use your content to train AI models. When we use third-party AI services, we apply contractual terms and settings designed so that your content is not used to train or improve their models.

Because of how AI works, Outputs may not be unique, and similar outputs may be generated for others. We do not guarantee that any Output is protected by intellectual property rights or free of third-party rights.

You confirm that you have the rights needed for your Inputs. You are responsible for complying with the licenses of any third-party content, software and open-source components in your projects.

9. AI outputs

AI-generated Outputs can contain errors, omissions, inaccurate information or security weaknesses. Before you rely on, publish or share an Output or a project, review it, test it and check that its access, authorization and security settings fit how it will be used. Outputs are not legal, financial, medical or other professional advice.

10. Your apps and their users

You are responsible for the sites and apps you build and publish with Firevibe, including their content, the products and services you offer through them, your users and customers, and your own terms, privacy notices and legal compliance.

You are responsible for configuring and testing the sign-in, user roles, data and file access, and permissions that you control in your projects. Having a sign-in screen does not by itself mean access is properly restricted. We remain responsible for the security of the parts of the Services that you cannot access or configure.

When we process personal data of your users on your behalf, our Data Processing Addendum applies.

11. API keys and connected services

Enter API keys and other secrets only in your project's Resources → API keys section. Never put them in chats, documents, public pages or code that visitors' browsers can read.

Saved keys are not shown again and are not shown to the AI agent, which refers to them by name. They are used only by authorized parts of our system, and only to run the connection you set up.

You confirm that you are authorized to use each key you add. Limit each key's permissions to what you need, and revoke or rotate it with its provider right away if you suspect it has been exposed. Third-party services you connect are governed by their own terms and fees, which are your responsibility.

12. Acceptable use

You may not use the Services, or anything you build with them, to:

  • create, publish or distribute illegal content;
  • commit fraud or phishing, or collect credentials or payment details under false pretenses;
  • create or distribute malware;
  • gain unauthorized access to systems or data;
  • infringe or violate the rights of others;
  • interfere with the security or operation of the Services; or
  • manipulate the credit system, exceed usage, credit or access limits without permission, or work around the technical measures that enforce them.

If you find a security vulnerability, report it to help@firevibe.ai and do not exploit it.

13. Suspension and termination

You can stop using the Services at any time. You can delete projects and your account in the app. Deleting your account cancels your subscription so that no future charges are made, and permanently deletes your account and projects. Deleted accounts, projects and content cannot be restored. Records we must keep by law are retained only as required.

We may limit, suspend or end your access, in whole or in part, if you materially breach these Terms, use the Services unlawfully, endanger the security of the Services or others, fail to pay after notice, or if the law or a competent authority requires it. Any measure will be proportionate to the issue. Unless the law or security concerns prevent it, we will tell you the reason and how to respond. A suspension alone does not cancel your credits.

14. Changes to these Terms

We may update these Terms. We will tell you about material changes before they take effect, by email or in the app. If you keep using the Services after a change takes effect, the updated Terms apply. If you do not agree, stop using the Services and cancel your subscription. Changes do not reduce rights you have already paid for.

15. Disclaimers

To the extent the law allows, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free. This does not limit our responsibility to provide the Services as described in these Terms.

16. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.

To the extent the law allows, our total liability for all claims relating to the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the event that gave rise to the claim, or US$100.

These limits do not apply to liability for gross negligence, willful misconduct or fraud, or to any liability that cannot be limited by law.

17. Indemnity

You will defend and indemnify Firevibe against third-party claims, and related losses and reasonable costs, arising from your content, the sites and apps you build or publish, your users, or your breach of these Terms, to the extent caused by you. We will notify you promptly of any such claim and cooperate reasonably.

18. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. The state and federal courts located in Delaware have exclusive jurisdiction over disputes relating to these Terms or the Services. This does not take away any mandatory consumer protection that the law of your place of residence gives you.

19. General

These Terms, together with our Privacy Policy, our Refund and Cancellation Policy, our Data Processing Addendum where it applies, and the order details shown at checkout, are the entire agreement between you and us about the Services.

Neither party is responsible for failing to perform because of events beyond its reasonable control, such as natural disasters, war, epidemics or acts of government. If such an event prevents us from providing the Services for more than 30 days, you may end your subscription, and any amount owed to you will be refunded under our Refund and Cancellation Policy or applicable law.

If any part of these Terms is found unenforceable, the rest remains in effect. Not enforcing a right is not a waiver of it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.

We send notices to the email address on your account. You can send notices to us at help@firevibe.ai. These Terms are written in English, and the English version governs.
